ACLJ Considering Legal Action if Dems Ignore Mass. Sen. Election Outcome and Force Healthcare Reform

WASHINGTON, Jan. 20, 2010—The nation's top conservative public interest law firm is considering legal action if Democrats refuse to recognize or delay the seating of newly elected Massachusetts Sen. Scott Brown. The American Center for Law and Justice (ACLJ) plans to file suit if the will of the Massachusetts electorate is ignored.
Senate Democrats will lose their 60 vote filibuster-proof majority once Brown is seated-putting passage of healthcare reform at risk. With Brown's victory, the Democrat-controlled Congress is said to be considering several options to speedily pass healthcare reform including sending the Senate-approved bill directly to the House ‘as is' and convince House Democrats to approve the measure-leaving incoming Brown without an opportunity to vote on healthcare reform.
"The people of Massachusetts have spoken and Sen. Brown must be seated without delay in the Senate," said Jay Sekulow, chief counsel of the ACLJ, a constitutional law firm with expertise in election law. "Any attempt to shut out Sen. Brown from the legislative process including preventing him from casting a vote on healthcare reform circumvents this election and clearly denies the will of the people of Massachusetts. We've assembled a team of lawyers to determine what legal action could be taken should Democrats refuse to recognize or delay the outcome of this election. Elections have consequences and the Democrats must understand that the consequences of a Sen. Brown victory mean it's time to put a stop to the flawed government-run, pro-abortion healthcare program that's been on a fast-track."
